Six Departments Including the CMC Logistic Support Department Issue Notice Strictly Prohibiting This Type of Sales Activity!

On July 23, six agencies — the CMC Logistic Support Department, CMC Equipment Development Department, CMC Political and Legal Affairs Commission, Ministry of Public Security, State Administration for Market Regulation, and State Administration of Science, Technology and Industry for National Defense — jointly issued a notice banning the sale, replication, and commercial promotion of retired and decommissioned PLA equipment, with China Rongtong Asset Management Group named as the sole authorized channel for approved component sales. The notice documents an enforcement gap: online and offline markets have been openly trading scrapped military hardware and convincing replicas in ways the existing regulatory framework apparently failed to suppress. The six-agency structure points to a coordination problem — no single body had sufficient jurisdiction — and the explicit carve-out for Rongtong raises the question of how tightly that channel is itself monitored.

According to the website of the State Administration for Market Regulation, the Central Military Commission Logistic Support Department, the Central Military Commission Equipment Development Department, the Central Military Commission Political and Legal Affairs Commission, the Ministry of Public Security of the People's Republic of China, the State Administration for Market Regulation, and the State Administration of Science, Technology and Industry for National Defense jointly issued on July 23 the "Notice on Prohibiting Sales Activities Involving Retired and Decommissioned Military Equipment."

In recent years, some operators have been openly selling—both online and offline—goods containing sensitive information related to our military's retired and decommissioned equipment (referring to all types of equipment, ammunition, devices, and related components and materiel that have been approved by the military for withdrawal from service and disposed of as scrap), causing adverse effects and creating safety hazards. In order to safeguard the interests of the state and the military and the positive image of the People's Army, and to eliminate risks and hidden dangers to public safety and military secrets, the following is hereby announced:

1. It is strictly prohibited for any unit or individual to sell retired and decommissioned military equipment. Exceptions apply to items listed in the publicly released sales catalog of disassembled components from retired and decommissioned equipment (for both military and civilian use) formally published by China Rongtong Asset Management Group Co., Ltd., as well as other equipment approved for sale by the military.

2. It is strictly prohibited for any unit or individual to manufacture, modify, or use disassembled components from retired and decommissioned equipment to assemble or piece together replicas, and to sell replicas sufficient to cause the public to regard them as military equipment.

3. It is strictly prohibited for any unit or individual, in any form, to conduct commercial marketing and promotion of retired and decommissioned military equipment and replicas sufficient to cause the public to regard them as military equipment.

Relevant functional departments shall cooperate closely and strengthen routine supervision and inspection of market sales and commercial marketing and promotional activities involving retired and decommissioned military equipment. Those that endanger public safety, military secrets security, or otherwise violate relevant legal provisions shall be investigated and dealt with seriously in accordance with laws and regulations; those whose conduct constitutes a crime shall be held criminally liable in accordance with the law.

据市场监管总局网站消息,中央军委后勤保障部、中央军委装备发展部、中央军委政法委员会、中华人民共和国公安部、国家市场监督管理总局、国家国防科技工业局7月23日发布《关于禁止涉军队退役报废装备销售活动的通告》。 近年来,部分经营者在线上线下公开销售涉及我军退役报废装备(指经军队批准退出服役状态、作废品处理的各类装备、弹药、设备及相关部件、器材等)等敏感信息的商品,造成不良影响,产生安全隐患。为维护国家、军队利益和人民军队良好形象,消除社会公共安全和军事秘密安全风险隐患,现就有关事项通告如下: 一、严禁任何单位和个人销售军队退役报废装备。列入中国融通资产管理集团有限公司正式发布的退役报废装备拆解件(军民通用)公开销售目录,以及军队批准的其他装备除外。 二、严禁任何单位和个人生产、改装或利用退役报废装备拆解件等拼装、组装,且销售足以使公众视为军队装备的仿制品。 三、严禁任何单位和个人,以任何形式进行军队退役报废装备和足以使公众视为军队装备的仿制品商业营销宣传。 相关职能部门要密切配合,加强对涉军队退役报废装备市场销售和商业营销宣传活动的常态化监督检查。对危及社会公共安全、军事秘密安全等,以及违反有关法律规定的,依法依规严肃查处;构成犯罪的,依法追究刑事责任。
